Your privacy is important to us. This policy explains the information practices of BudBoard, LLC, a Delaware limited liability company (together with its successors and assigns, “budboard”, “we”, “us” or “our), defines the privacy options of each of our users (as further defined below, each, a “user”, “you” or “your”) and describes how your information is collected and used by us, the owner and operator the budboard Customer Review App (the “App”) and our any of our related sites, services, tools or applications (together with App, collectively, the “Services”).

By using or visiting the Services, whether or not you create an account with us, you agree to the collection and use of information in the manner described in this policy. Budboard shall have right at any time and without prior notice, at its sole discretion, to revise this policy. Such revisions and additions shall be effective immediately upon notice, which may be given by any means, including but not limited to posting the revised policy on the Site. You are responsible for reviewing the Site periodically for any modification to this policy.

THE SERVICES AND THE INFORMATION WE COLLECT

The Services consist of web-based review collection software that allows consumers (each, a “Consumer”) to upload, post, publish or submit reviews on products or services offered by manufacturers, retailers or other applicable businesses (any such manufacturer, retailer or other applicable business whose products are reviewed through the Services, a “Merchant”). The Services may also include without limitation a web-based dashboard enabling Merchants to view applicable reviews that have been collected through the Services. For purposes of these Terms, a user of the Services may be a Consumer, or acting as or on behalf of a Merchant, or both, and the terms “user”, “you” or “your” shall be construed accordingly.

This policy applies to all information collected through the Services and any information you provide to budboard, whether or not you create an account with us. Additional detail about information that you provide to us and information that we collect through or in connection with your use of the Services, organized by category, is set forth below.

INFORMATION YOU PROVIDE TO US

To use certain features of the Services or participate in certain activities sponsored by budboard, you may be required to create an account with us. You may also provide us with personal information when use any of the Services or tools or participate in certain budboard-sponsored activities. The personal information we collect when you create a budboard account includes: your name; your email address; and a password that you select. We may allow you to create a budboard user account through the use of a third-party service such as Facebook, in which case we will collect personal information provided through such third-party service in accordance with your privacy settings with such third-party service. 

If you contact us directly, we may receive additional information about you. For example, when you contact us about customer support issues, we may receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide.

DEVICE INFORMATION

We may receive and collect information from your mobile or other device, including IP address, web browser type, mobile operating system version, wireless carrier, device manufacturer, application installations, device identifiers, mobile advertising identifiers, push notification tokens, and, if applicable, identifies associated with one or more social media accounts.

USAGE DATA

In addition to the personal information you supply, we collect certain information to evaluate how you and other users use and interact with the Services. We use such data in the following ways: to improve the design of the Services, to provide personalization on Services, to evaluate the performance of our various features, activities and programs and for our internal business analysis purposes. The technologies we may use to gather this non-personal information may include analytics software, IP addresses, cookies, browser detection, device detection and weblogs.

HOW WE USE INFORMATION

Our primary goal in collecting your information is to provide you with an efficient means of submitting reviews of applicable products (in the case of users who are Consumers) or an efficient means of viewing and otherwise using such reviews and related content (in the case of users who are acting as or on behalf of applicable Merchants). We also collect your information for the more general purpose of providing you with a positive experience when using the Services or other budboard products or services.

We may use information provided by you for one or more of the following purposes, where applicable: to manage your account; to process transactions and to provide the features of the Services; to present content in a manner effective for you and your device; to notify you about changes to the Services or address questions you may have about the Services; and to send you messages in accordance with your marketing preferences.

We may contact you with promotions and updates relating to the Services, or for other activities and purposes. The contact information you submit will not be used for these purposes if you choose not to receive such communications. You can control your privacy preferences regarding such communications (see the section below entitled “YOUR PRIVACY PREFERENCES”) and can unsubscribe to any emails you receive.

From time to time, you may be invited to participate in budboard-sponsored activities or programs. Budboard may request that you provide some or all of the above listed personal information to participate in those activities or programs. We use information collected from activities and programs to learn about users in order to improve our services and develop new products and services of interest to our customers.

As discussed above, we may use analytics software and other tools to collect data about how users use and interact with the Services. We may use this data to better understand various aspect of the Services, such as which features of the Services are most useful to users and which features may require improvements in future iterations of the Services. We may detect the type of web browser or device you are using to optimize the performance of the Services and to understand the mix of browsers and devices used by our users and visitors.

Budboard may also contract with unaffiliated third parties to provide services, such payment processing, analyzing and evaluating the information we collect, and other services. When we do this, we may provide your personally identifiable information to third parties only to provide those services, and they are not authorized to use your personally identifiable information for any other purpose.

OUR COMMITMENT TO DATA SECURITY

Access to your data is limited to authorized budboard staff or approved vendors. Although total security does not exist on the Internet, budboard shall make commercially reasonable efforts to safeguard the information that you submit to budboard.

USE OF THE SERVICES BY CHILDREN

The Services are not intended for use by children. Budboard will not knowingly collect any personally identifiable information submitted by users of or visitors to the Services site who are under the age of 18. If you are under the age of 18, please do not use the Services or submit any personal information through the Services. We encourage parents and legal guardians to monitor their children’s internet and mobile device usage and to help enforce this privacy policy by instructing their children never to provide personal information through the Services. If you have reason to believe that a child under the age of 13 has provided personal information through the Services, please contact us, and we will endeavor to delete that information from our databases.

YOUR PRIVACY PREFERENCES

Budboard may provide or make available to users marketing communications such as email newsletters, product and service updates and promotions. Should you choose to not receive such future communications, you can follow the “unsubscribe’” or similar instructions at the bottom of the email sent by budboard.

In the event that we provide promotional text messages to you, we will also provide instructions on how you can opt out of receiving such messages. 

In the event that we provide push notifications to you through your mobile device, you can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may limit the effectiveness of your use of the Services.

In most cases, you can prevent your mobile device from sharing location information with us in your device settings. Please note that adjusting your device settings to limit sharing of location with us may limit the effectiveness of your use of the Services.

HOW TO ACCESS OR CORRECT YOUR PROFILE INFORMATION

You can review and edit certain user account information (if applicable) by logging in to your account settings and profile. If would like to terminate your budboard user account, please contact us through the “Contact” or similar portion of the Services. If you choose to terminate your account, we will deactivate it for you but may retain information from your user account for a certain period of time and disclose it in a manner consistent with the purposes described in this policy for accounts that are not closed. We also may keep certain information associated with your user account to resolve disputes, troubleshoot problems, analyze usage of the Services, assist with any investigations, prevent fraud, enforce our Terms of Use or take other actions as required or permitted by law.

DISCLOSURE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process. It is also possible that budboard would sell all or substantially all of its assets and business. In any transaction of this kind, customer information, including your personally identifiable information, may be among the assets that are transferred. If we decide to so transfer your personally identifiable information, you will be notified by email or a post to the Site.

PRIVACY AND LINKS TO THIRD PARTY WEBSITES

The Services may contain links to other websites. Budboard is not responsible for the privacy practices of these other sites. We encourage you to be aware when you leave our site, and to read the privacy statements of each web site that collects personally identifiable information. Some linked sites may be co-branded with our trademarks and those of our business partners. They may have the look and feel of the Services, but the URL in your browser window will indicate that you are visiting a different site. This policy only applies to information collected by budboard.
